These Terms of Use govern your access to nyflorale.com (the “site”), operated by Florale. By using the site, you agree to these terms. If you do not agree, please do not use the site.
1. About the site
Florale is a floral design studio based in Highland, New York, serving weddings and events across the Hudson Valley, New York City, the Catskills, and select destinations. The site provides information about our work and a way to request a consultation.
2. Inquiries are not bookings
Submitting an inquiry does not reserve a date, create a client-service relationship, or require either party to proceed. Availability, scope, pricing, payment, cancellation, and other service terms are established only in a separate written proposal or agreement accepted by Florale and the client.
3. Intellectual property
The site and its text, photographs, graphics, floral designs, branding, logos, layout, and other original content are owned by Florale or used with permission and are protected by applicable intellectual-property laws. You may view the site for personal, non-commercial purposes. You may not reproduce, republish, modify, distribute, sell, scrape, or commercially exploit site content without prior written permission from the applicable rights holder.
4. Acceptable use
You agree not to:
- Use the site in violation of applicable law.
- Attempt to gain unauthorized access to the site, its systems, or information submitted by others.
- Introduce malicious code, interfere with operation, or place an unreasonable load on the site.
- Misrepresent your identity or submit information you do not have the right to provide.
5. Third-party services and links
The site may link to or rely on third-party services, including Instagram and technology providers. Those services are governed by their own terms and privacy practices. Florale does not control and is not responsible for third-party content, availability, or practices. A link does not imply endorsement.
6. Informational content and disclaimers
We work to keep the site accurate and available, but portfolio, service, pricing, availability, and other information may change. To the fullest extent permitted by law, the site is provided “as is” and “as available,” without warranties of uninterrupted access, error-free operation, or fitness for a particular purpose. Nothing on the site is professional legal, financial, or event-planning advice.
7. Limitation of liability
To the fullest extent permitted by law, Florale will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the site. Nothing in these terms excludes liability that cannot legally be excluded or limited.
8. Privacy
Our Privacy Policy explains how we handle information collected through the site.
9. Changes and availability
We may update the site or these terms, or suspend part of the site, at any time. Updated terms take effect when posted and will show a revised effective date. Continued use after an update means you accept the revised terms.
10. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute relating to the site will be brought in a state or federal court with proper jurisdiction in New York, except where applicable law requires otherwise.
11. Severability and entire terms
If any provision is held unenforceable, the remaining provisions remain in effect. These terms are the entire agreement concerning use of the site; they do not replace a separately executed client agreement for floral-design services.
